Norfolk Electrical Activities is a Queensland electrical, solar and battery services business. In these Terms and Conditions, “we,” “us” and “our” refer to Norfolk Electrical Activities Pty Ltd, trading as Norfolk Electrical Activities.
These Terms and Conditions apply when a person:

If a customer requests or purchases services, the following may also apply: a written quotation, a proposal, a scope of works, payment terms, a booking agreement, a service agreement, an installation agreement, or product or manufacturer warranty terms.
If there is an inconsistency concerning the actual work, the later and more specific written service document will prevail to the extent of that inconsistency. Nothing in these website terms removes rights that cannot lawfully be excluded.

Solar output, battery performance, electricity savings, payback periods, rebates and system suitability may depend on:

3. Electrical safety and emergencies
Do not use the website to diagnose electrical faults or perform electrical work. Electrical work must be performed by appropriately licensed persons. Users must not touch exposed wiring, damaged electrical equipment, unsafe switchboards, damaged solar components, damaged batteries, or equipment that may be energised or unsafe.
For an immediate danger, fire, electric shock or life-threatening emergency, call 000 and follow the directions of emergency services. Customers may also need to contact their electricity distributor for supply emergencies. Website enquiries are not monitored as an emergency service.
4. Enquiries, estimates and quotations
Submitting an enquiry does not create a contract, does not require us to accept the work, does not confirm a booking, and does not guarantee that the requested service is available.
Any price, range, saving, rebate or timeline shown on the website is indicative unless confirmed in a written quotation. A quotation may be subject to:

5. Solar, battery and network matters
Solar and battery projects may depend on electricity-distributor requirements, electricity-retailer requirements, export limits, meter changes, network approvals, government programs, rebate eligibility, certificate eligibility, manufacturer requirements, internet connectivity and third-party approvals. Unless expressly included in writing, we do not control those third parties.
We do not guarantee:

- Export approval or export capacity
- A particular electricity tariff
- Government rebate availability
- Government processing times
- Meter-installation timing
- Certificate eligibility
- A specific level of solar production
- A specific level of battery performance
- A specific electricity-bill reduction
- A specific payback period
- A financial return
Any performance estimate must be based on stated assumptions and must not be presented as a guaranteed result. Actual generation, storage, consumption and savings may vary. Product substitutions may only be made consistently with the accepted quotation, service documents, customer approval requirements and applicable law.
6. Customer responsibilities
When using the website or requesting services, a customer must:

- Correct material errors or changes promptly
- Have authority to request access, inspection or work at the property
- Obtain owner approval where required
- Obtain body-corporate approval where required
- Provide safe and reasonable property access

7. Bookings, access and delays
A requested appointment is not confirmed until we accept it. A customer who needs to reschedule or cancel should contact us as early as reasonably possible. Any call-out, cancellation, access or delay charge must be disclosed in the applicable quotation or booking terms, be lawful, and be reasonable in the circumstances.
We will use reasonable efforts to meet agreed timing. Timing may be affected by unsafe conditions, weather, equipment or supplier delays, network processing, government processing, hidden site conditions, property-access issues, customer-requested changes, or events beyond our reasonable control.
We will communicate material delays and work with the customer toward a reasonable solution. Nothing in this section removes rights that cannot lawfully be excluded.
8. Consumer guarantees and warranties
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Services must be provided with due care and skill, fit for any disclosed purpose that we agree to meet, and supplied within a reasonable time where no time is fixed.
Goods may also carry non-excludable consumer guarantees, including requirements concerning acceptable quality, fitness for disclosed purpose, correspondence with description, and other guarantees provided by law.
Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, statutory right, legal remedy, or liability that cannot lawfully be excluded, restricted or modified.
Manufacturer warranties and any express workmanship warranty are additional to Australian Consumer Law rights. Manufacturer warranties do not replace Australian Consumer Law rights. Project-specific warranty terms, exclusions and claim procedures should be set out in the applicable quotation, the applicable service or installation agreement, warranty documentation, or manufacturer materials.
9. Website availability and security
We may suspend, restrict or change the website for maintenance, security, updates, technical issues or operational reasons. We do not guarantee uninterrupted website access, and we do not guarantee that the website will be free from every error, defect, virus, malicious component or technical interruption.
Users are responsible for maintaining suitable device security, keeping software current, using appropriate antivirus and security controls, and independently backing up submitted or downloaded information.

These Terms and Conditions are governed by the laws of Queensland and the applicable laws of Australia. Subject to any non-excludable right to bring a claim elsewhere, the courts and tribunals of Queensland have jurisdiction.
If part of these Terms and Conditions is invalid or unenforceable, it should be read down where possible. The remaining provisions will continue to operate.
17. Changes to these terms
We may update these Terms and Conditions for future website use by publishing a revised version with a new effective date. Changes do not retrospectively alter an accepted quotation, scope of works, service agreement or installation agreement.
An existing agreement may only be changed where the parties agree, the applicable agreement permits the change, or the change is otherwise permitted by law.
